Terms and Conditions

1. Introductory provisions
1.1 These terms and conditions govern the rights and obligations between the seller and the buyer when purchasing credit, subscriptions, applications with a subscription and downloadable applications through the online shop eshop.aimasterplans.eu (the "portal").
1.2 Seller: Ing. arch. Martin Baloga, registered office at Námestie svätého Egídia 53/23, 05801 Poprad, Company ID (IČO): 41879171, Tax ID (DIČ): 1074469671, VAT ID: SK1074469671, trade register entry: č.740-19353 č.Žo 2005/05936/2/SR. Contact: matobaloga@gmail.com, tel. +421 903 314 492.
1.3 The buyer is either a consumer or a business. A consumer is a natural person who, when concluding and performing the contract, does not act within the scope of their business or profession. Provisions on consumer rights do not apply to businesses.
1.4 Matters not governed by these terms and conditions are governed by the law of the Slovak Republic, in particular the Civil Code, Act No. 108/2024 Coll. on Consumer Protection and Act No. 22/2004 Coll. on Electronic Commerce.
2. What we sell
2.1 Credit – a prepaid value from which consumption is deducted when artificial intelligence (“AI”) models are used in our applications.
2.2 Credit package – a one-off purchase of a certain number of credits.
2.3 Subscription – a recurring service with a billing period of one month, quarter, half-year or year as chosen by the buyer. The credit stated with the subscription is added to the account credit at the start of each month of the paid period, also when paying for a longer period, and during the paid period the subscription gives access to the models stated with it.
2.4 Downloadable application – digital content (an installation file and its updates) that the buyer downloads in their account.
2.5 Application with a subscription – a service for one installation of an application (e.g. AIgis including web GIS hosting), paid repeatedly for a chosen period and having its own subscription credit. Details are set out in clause 7A.
2.6 Discount coupon – a code from a promotion of the seller which the buyer enters when ordering and for which the buyer receives extra credits after payment. Details are set out in Article 8A.
2.7 The main characteristics, price and conditions of each product are stated with the product in the portal. For products that the seller provides only on the basis of a contract (clause 7A.10), an indicative lowest price (“from”) is stated; the final price is set by the contract.
3. Account
3.1 Registration is required to purchase and use credit. The buyer must provide truthful information and protect their password and keys against misuse.
3.2 The buyer may use keys and sign-ins issued by the portal only in the seller's applications. In the event of misuse (e.g. use of a key outside our applications, an attempt to circumvent usage metering, or unlawful use), the seller may block the key or the account.
3.3 The buyer may close the account at any time by sending a request to matobaloga@gmail.com.
4. Order and conclusion of the contract
4.1 The offer in the portal is not a proposal to conclude a contract. The buyer selects a product, checks and completes the billing details, chooses a payment method, confirms their agreement with these terms and conditions and submits the order with the button “Order with obligation to pay” (in the Slovak version „Objednať s povinnosťou platby“).
4.2 The contract is concluded upon payment of the order. The seller sends the buyer a confirmation of the conclusion of the contract together with these terms and conditions and the invoice by e-mail.
4.3 For a subscription, an application with a subscription and automatic top-up, the buyer agrees to recurring payments under clauses 7, 7A and 8.
5. Price and payment
5.1 Prices are stated in euros including VAT. Prices may change; the price valid at the time the order is submitted applies to the buyer. The price depends on the current EUR/USD exchange rate and on the prices per token charged by the providers.
5.2 Payment can be made by payment card or by another method offered by the payment gateway (GoPay, Tatrapay+). The buyer enters payment details directly on the payment gateway's page; the seller neither sees nor stores card numbers.
5.3 A buyer who is a business or a legal entity with a company ID (IČO) (including municipalities and other public administration bodies) may also pay for an application with a subscription by bank transfer against an invoice, on the basis of a contract for work. The invoice is payable within 14 days of issue.
5.4 The seller issues the invoice electronically; it is also available in the buyer's account.
6. Delivery
6.1 Credit is added to the account immediately after the payment gateway confirms the payment.
6.2 The seller makes a downloadable application available in the buyer's account immediately after payment. Updates to the application are available for as long as the seller develops the application.
6.3 Account credit does not expire for as long as the buyer's account exists. The credit of an application with a subscription is governed by clause 7A.
7. Subscription
7.1 The subscription renews at the end of the chosen billing period (month, quarter, half-year or year) and the payment for the next period is charged automatically to the card the buyer entered when ordering.
7.2 The buyer may cancel the subscription at any time in their account (Subscription). The subscription then remains valid until the end of the paid period, credit continues to be added each month until then, and no further payment is charged. The price for the unused part of the paid period is not refunded, except on withdrawal under Article 9.
7.3 The seller will notify the buyer of a change in the subscription price by e-mail at least 30 days in advance; the buyer may cancel the subscription before the change.
7A. Application with a subscription
7A.1 Each application subscription applies to one installation of the application and has its own number. The buyer may hold several subscriptions to the same application and, alongside them, a subscription under clause 7; these subscriptions are independent of each other.
7A.2 When ordering, the buyer chooses the billing period (monthly, quarterly, half-yearly or yearly – as offered with the product) and the payment method. The price for each period is stated with the product; for a subscription under a contract (clause 7A.10), the price agreed in the contract applies.
7A.3 When paying by card, the subscription starts after payment and the payment for the next period is charged automatically to the card. When paying by invoice (clause 5.3), the subscription starts immediately after the order is submitted; the seller issues the invoice for the next period 14 days before it begins and sends it by e-mail.
7A.4 The subscription has its own credit. The credit stated with the product is added at the beginning of each month of the paid period, also when paying for a longer period. The subscription credit may be spent only by the installation of the application to which the subscription belongs; it is not combined with the account credit or with the credit of another subscription and cannot be transferred. Unused credit carries over to the following months for as long as the subscription lasts.
7A.5 The buyer may cancel the subscription at any time in their account (Subscription). The subscription then remains valid until the end of the paid or invoiced period, and no further payment or invoice will follow. When the subscription ends, the application stops working and the unused subscription credit is frozen.
7A.6 The buyer may renew an ended subscription in their account within 12 months of its end; the subscription keeps its number and the frozen credit becomes available again. If the buyer does not renew the subscription within 12 months of its end, the unused subscription credit expires without compensation. The buyer can see the credit balance and the date on which it would expire in their account.
7A.7 If the application includes hosting (e.g. web GIS), the seller keeps the data the buyer uploads to it for 6 months.
7A.8 The seller will notify the buyer of a change in the subscription price by e-mail at least 30 days in advance; the new price applies from the first period after this notice period has elapsed. The buyer may cancel the subscription before the change.
7A.9 If the buyer is more than 30 days late in paying an invoice, the seller will notify the buyer and, if the invoice is not paid within an additional period of 7 days, may suspend the subscription until the invoice is paid.
7A.10 The seller provides some applications with a subscription (e.g. AIgis for municipalities) only on the basis of a separate contract (e.g. a contract for work); they cannot be ordered online in the portal. After the contract is signed, the seller makes the subscription available in the buyer's account. The scope of the service, the price, invoicing, the monthly credit (which may also be zero if only hosting is provided), the term and termination are governed by the contract; the price, monthly credit and other conditions agreed in the contract take precedence over the price and conditions stated with the product in the portal. The buyer can see the name of the subscription, the price per billing period, the monthly credit and the contract number with the subscription in their account; invoices issued by the portal for the subscription state the contract number. If the conditions in the contract change (e.g. by an amendment), the seller will update them in the portal: the new price applies from the first invoice issued after the change takes effect, and the changed monthly credit from the following month. Invoices already issued are not changed. These terms and conditions apply to the extent that the contract does not provide otherwise.
8. Automatic top-up
8.1 The buyer may turn on automatic top-up in the account: when the credit falls below a chosen threshold, the portal buys the chosen credit package and pays for it with the saved card.
8.2 Automatic top-up can be turned off at any time. The number of top-ups per day is limited to prevent unexpected payments.
8A. Discount coupons (promotions)
8A.1 The seller may announce a promotion with a discount coupon. For each promotion, the seller publishes its name, the coupon code, the number of extra credits, the validity period and the products to which the coupon applies.
8A.2 The buyer enters the code in the order before submitting it; the portal shows how many extra credits the buyer will receive. The code can be applied only while the promotion is valid, including its last day (Slovak time); the time the order is submitted is decisive. A code entered later, after the order has been submitted, cannot be applied.
8A.3 The seller adds the extra credits after the order is paid (when paying by invoice, after the invoice is issued) to where the purchase is directed: to the buyer's account, or to the credit of the application with a subscription to which the buyer assigned the purchase or which the buyer ordered (clauses 6.1 and 7A.4). The extra credits are stated on the invoice and in the order confirmation.
8A.4 Each buyer (portal account) may use each coupon at most once, and only in one order. If the buyer pays several orders with the same code, extra credits are granted only for the first paid order. One coupon may be entered per order. Neither the coupon nor the extra credits can be exchanged for money or transferred to another account.
8A.5 Extra credits are free of charge and are not part of the price. If the buyer withdraws from the contract (Article 9) or the payment is refunded, the extra credits from that order lapse; when settling consumed credit under clause 9.3, consumption is counted first against the paid credits.
8A.6 Extra credits are subject to the same rules as the credit to which they were added (clause 6.3; for an application with a subscription, clause 7A.6).
8A.7 If the buyer misuses a coupon, e.g. by applying it repeatedly through several accounts of the same person, the seller may remove the extra credits obtained through such misuse.
8A.8 The seller may extend a promotion. The seller may shorten it only for serious reasons and by announcing it in the portal; orders submitted before the announcement are handled under the original conditions of the promotion.
9. Withdrawal from the contract (consumer)
9.1 A consumer may withdraw from the contract without giving any reason within 14 days from the day the contract was concluded.
9.2 Downloadable application (digital content): if, before ordering, the consumer expressly agreed to the supply beginning before the withdrawal period expires and declared that they had been informed that they thereby lose the right of withdrawal, the consumer has no right to withdraw from the contract once the downloadable application has been made available (Section 19(1) of Act No. 108/2024 Coll.). The consumer receives confirmation of this consent by e-mail.
9.3 Credit and subscription (service): if the consumer expressly requested that the service begin before the withdrawal period expires and then withdraws, the consumer pays the price for the performance actually provided – the consumed credit. The seller refunds the proportionate part of the price for the unused credit. Once the service has been fully provided (the credit has been used up), the consumer has no right of withdrawal, provided they were informed of this.
9.3a Application with a subscription (service): if the consumer expressly requested that the service begin before the withdrawal period expires and then withdraws, the consumer pays the proportionate part of the price for the period during which the service was provided and the price of the consumed subscription credit; the seller refunds the rest.
9.4 Withdrawal can be made using the “Withdraw from the contract here” function in the portal footer (no sign-in required) or by e-mail to matobaloga@gmail.com. The seller confirms receipt of the withdrawal by e-mail.
9.5 The seller refunds payments within 14 days of receiving the withdrawal, using the same method by which the payment was received.
10. Liability for defects and complaints
10.1 The seller is responsible for the credit, subscriptions and applications being in conformity with the contract. The complaints procedure is set out in the Complaints Procedure.
10.2 AI model outputs are produced by third-party models (AI providers). They may be inaccurate or incomplete and the buyer must verify them before use. The availability of individual models depends on their providers; if a provider withdraws a model, the seller may replace it with a comparable model.
11. Personal data protection
The processing of personal data is described on the Privacy Policy page.
12. Dispute resolution and supervision
12.1 A consumer may send a complaint or grievance to matobaloga@gmail.com. If the consumer is not satisfied with how it was handled, or if the seller does not respond within 30 days, the consumer may submit a proposal for alternative dispute resolution to an alternative dispute resolution body, e.g. the Slovak Trade Inspection (www.soi.sk). The list of these bodies is kept by the Ministry of Economy of the Slovak Republic (www.mhsr.sk).
12.2 Supervisory authority: Slovak Trade Inspection (Slovenská obchodná inšpekcia), Inspectorate for the Prešov Region, Obrancov mieru 4675/6, 080 01 Prešov.
13. Use of AI models and content sent by the buyer
13.1 Content that the buyer sends to an AI model in our applications (texts, files, images, map and other data) is passed by the seller's gateway for processing to the provider of the selected model, which is a third party (e.g. Anthropic, OpenAI, Google). The provider processes it in accordance with its API terms. The seller does not store the content of requests; it stores only usage data.
13.2 The buyer is responsible for the content they send to an AI model and for how they use its output. The buyer may send only content they are entitled to use in this way (in particular under copyright law, data protection rules and confidentiality obligations), and personal data of other persons only to the extent strictly necessary for the task and with a legal basis for passing it on.
13.3 The buyer must not send to an AI model:
- passwords, PINs, access codes, API keys, tokens, private keys and certificates or other access credentials (whether their own or other people's);
- payment card numbers and access credentials to banking and payment services;
- national identification numbers (rodné čísla), identity document numbers and special categories of personal data (e.g. data concerning health, religion, political opinions, biometric and genetic data), unless the task strictly requires it and the buyer has a legal basis for it;
- classified information and information subject to a duty of confidentiality (e.g. official, trade or banking secrets), unless the buyer is authorised to disclose it to a third party.
13.4 The buyer must not use AI models in breach of the law or of the usage policies of the AI providers (OpenAI, Anthropic and others depending on the selected model), in particular not for:
- threats, harassment, incitement to violence or hatred, and support of terrorism;
- the development or use of weapons (including chemical, biological, radiological and nuclear weapons), the creation of malicious code and attacks on computer systems;
- fraud, deception and manipulation, fake reviews, disinformation campaigns, networks of fake accounts and interference with elections;
- any content that exploits, endangers or sexualises persons under 18 years of age;
- monitoring persons without their consent, biometric identification, profiling or “social scoring” and inferring sensitive characteristics of persons;
- imitating the likeness or voice of a specific person without their consent in a way that may mislead;
- infringing the intellectual property rights and privacy of other persons;
- circumventing the safety measures of AI models, usage metering or the limits of the portal.
13.5 If the buyer uses AI outputs in decisions that affect the health, rights, finances, employment or access to services of persons (e.g. in administrative proceedings or when assessing applications), the output must be reviewed before the decision by a qualified person who is able to change it. The buyer informs the persons concerned about the use of AI where required by law (e.g. the EU Artificial Intelligence Act) or by the rules of the AI provider.
13.6 AI model outputs may be inaccurate, incomplete or outdated (clause 10.2); the buyer must verify them before use and must not present them as the result of human work where this could be misleading.
13.7 In the event of a breach of this Article, the seller may block the key or the account (clause 3.2) and the AI provider may restrict access to the model. The seller is not liable for damage caused by content the buyer sent in breach of this Article; the buyer shall compensate the seller for any damage incurred as a result (e.g. a claim by an AI provider or by an affected person).
14. Final provisions
14.1 The seller may change these terms and conditions. The version in force at the time a contract is concluded applies to that contract; the seller will notify changes to the conditions for subscriptions and applications with a subscription by e-mail in advance.
14.2 These terms and conditions are effective from 17.10.2026.
